Ban Lifted for Employees Made to Do Other Jobs in the UAE

The Ministry of Labour introduces guidelines set to alleviate restricting conditions

The labour ministry in the UAE has issued dramatic changes to the current six-month bans placed on workers who leave their jobs.

From this point forward, the ban does not apply to those workers that were performing a job other than what they were hired to do.

It is a common business practice to hire an employee, but assign them an alternative responsibility after they have begun working in the UAE.  Within the new guidelines if that employee can prove this was the case, he will not be put under the six-month ban upon the cancellation of his visa.

The current regulations state that those who leave their employed positions and are unable to provide a no-objection slip from the business will be put under a six-month ban.

This rule does not apply to persons employed by a business for over three years.

The change is on the heels of registered complaints by workers issued a 12-month ban by their past employer.

Lawyer Aji Kuriakose of Sharjah commented positively on the changes, stating that these guidelines will alleviate the pressures of those who wish to leave their positions.  Kiriakose said that there are numerous accounts of workers performing jobs other than what they were hired for.

The Ministry of Labour had the work ban under review in 2009, looking to smooth out issues in the labour market.

Over the nine month period from January to September this year, the Ministry has issued approximately 530,000 permits for work.

The Executive Director of Labour Affairs at the Ministry, Humaid bin Dimas Swedi, stated that 111,000 businesses have felt the benefits of the implementation of electronically issued work permits.
